Burneikis Law

Rockridge's Trusted Personal Injury Attorney

Rockridge is one of Oakland’s most walkable neighborhoods. Residents walk to College Avenue for dinner, commute through the Rockridge BART station, and ride bikes past Craftsman bungalows along streets the neighborhood has called home for over a century. That daily street life is what makes Rockridge worth living in. It also puts residents in direct contact with vehicle traffic every time they step outside.

The problem is structural. Highway 24 runs along the neighborhood’s southern edge, feeding commuter traffic onto local streets. Alcatraz Avenue and Claremont Avenue absorb drivers cutting through to reach the freeway. The City of Oakland rates the Broadway and 51st Street intersection Level of Service F, its worst designation. And the 14-block College Avenue commercial corridor combines delivery trucks, rideshare pickups, double-parked vehicles, cyclists, and pedestrians in a space designed for a quieter era.

If you were injured in Rockridge by a driver, a negligent property owner, or a vehicle you never saw coming, Burneikis Law handles personal injury cases throughout Oakland, including Rockridge. Our Oakland personal injury lawyer page covers the full scope of what we handle and the results we’ve achieved.

Why Choose Us

Why Rockridge Residents Choose Burneikis Law

Rockridge residents tend to approach things carefully, especially decisions that matter. That is a fair way to choose a lawyer.

Monica Burneikis is based in downtown Oakland, not a satellite office of a San Francisco firm. She knows Alameda County courts, Oakland traffic corridors, and the specific infrastructure problems that produce injury claims in this city. When she reviews a Rockridge case, she already knows the Broadway and 51st intersection, the College Avenue bike lane design issues, and the cut-through speeding on Martin Street and Hillegass that the Rockridge Community Planning Council documented across 43 intersections in 2025.

That local knowledge is relevant to your case. Proving negligence after a traffic collision often requires demonstrating that a dangerous condition was known and foreseeable. Oakland’s own data, the 2024 High-Injury Network designation for MacArthur Boulevard and Claremont Avenue, and the Level of Service F rating at Broadway and 51st, support claims that injuries in these locations were not random.

Personal Injury Services in Rockridge

Pedestrian Accidents on College Avenue

The College Avenue corridor draws over 80 restaurants, cafes, and shops into 14 blocks between Alcatraz Avenue and 51st Street. Foot traffic is constant. Vehicle behavior is not.

Double-parking narrows travel lanes. Crosswalk timing at the Rockridge BART station creates conflict points during morning and evening peaks. The 2019 collision at Chabot Road and College Avenue, which critically injured a man and closed streets in the middle of the shopping district, shows what these conditions produce when a driver is careless. Peralta Elementary School on the neighborhood’s lower edge adds a school zone dimension to pedestrian exposure during drop-off and pick-up hours.

If a driver hit you in the College Avenue area or near the BART station, you may have a claim. We handle these cases on contingency.

Bicycle Accidents

Rockridge has an active cycling community. The College Avenue bike lane has documented design problems, including right-hook crash risks where the lane merges improperly relative to right-turn vehicle traffic. Dooring incidents happen regularly in the commercial parking zones along College Avenue. Cyclists forced into the travel lane by double-parked delivery vehicles face moving traffic with no margin for error.

The Hillegass Avenue intersections at 62nd and 63rd Streets, identified in the 2025 community traffic study as high-volume zones with inadequate pedestrian and cyclist protection, illustrate where design gaps and driver behavior intersect.

We handle bicycle accident claims involving dooring, sideswipe, right-hook, and intersection collisions throughout Rockridge.

Car Accidents at Broadway, 51st Street, and Highway 24 Access Points

The City of Oakland’s Level of Service F rating at Broadway and 51st Street is not a formality. It reflects severe congestion, wrong-way drivers, and cut-through speeding as commuters queue for the Highway 24 on-ramp. Rear-end collisions, sideswipes, and intersection T-bones occur here at predictable frequency.

Martin Street, a residential street adjacent to the Highway 24 on-ramp, became a documented hazard when residents reported drivers reaching dangerous speeds to reach the freeway during peak hours. The same pattern plays out on Alcatraz and Claremont avenues.

If you were in a collision in this part of Rockridge, the intersection’s documented failure and the neighborhood’s known cut-through traffic problem are directly relevant to your case.

Wrongful Death

If a family member died in a traffic collision in Rockridge, Monica handles wrongful death cases on the same contingency basis as personal injury cases. These cases require full accountability, not a fast settlement that undervalues what was lost.

Got Questions?

Frequently Asked Questions

I was hit by a car near the Rockridge BART station. What should I do first?

Get medical attention immediately, even if you feel fine. Adrenaline masks injuries, and documenting your condition early matters enormously to your claim. If you can, photograph the scene, the vehicle, and any visible injuries. Get the driver’s name, license plate, and insurance information. File a police report. Then call a personal injury attorney before speaking with any insurance adjuster. Insurers move quickly after accidents, and what you say in the first days can affect your recovery.

The driver who hit me on College Avenue says they weren’t at fault. Does that matter?

Insurance companies and drivers routinely dispute fault after accidents. What matters is the evidence: surveillance footage from nearby businesses, witness statements, the police report, traffic data, and the physical evidence at the scene. College Avenue has multiple documented infrastructure and traffic problems that frequently contribute to collisions. An attorney’s job is to build the case, not rely on the other driver admitting anything.

How long do I have to file a personal injury claim in California?

In most personal injury cases, California’s statute of limitations gives you two years from the date of injury to file a lawsuit. If a government entity is involved, for example, if a city-owned vehicle or a defective city intersection contributed to your injury, you typically have six months to file a government tort claim. Missing these deadlines means losing your right to recover. Do not wait.

Does it cost anything to talk to Monica about my case?

No. The initial consultation is free. Burneikis Law works on contingency, which means you pay no attorney fees unless we recover money for you. There is no upfront cost and no risk to getting a case evaluation.

The City of Oakland

About Rockridge

Rockridge sits in northeast Oakland, bounded by Alcatraz Avenue to the north (the Berkeley border with Elmwood), 51st Street and Pleasant Valley Avenue to the south, Broadway to the east, and Claremont Avenue to the west. Highway 24 runs along the southern edge, which shapes the neighborhood’s traffic character significantly.

The housing stock runs primarily 1910s to 1930s Craftsman bungalows, with Tudor and Spanish Revival homes on hillside lots in Upper Rockridge. Owner-occupants dominate. Families and long-term residents make up much of the core demographic.

Rockridge Market Hall on College Avenue, Pegasus Books, and a dense restaurant corridor give the neighborhood a village character. That same character means residents are on foot and on bikes regularly, on streets where commuter cut-through traffic accelerates toward the Highway 24 on-ramp. The pedestrian hazard at Pleasant Valley and Gilbert, where a signal pole blocks crosswalk access adjacent to senior housing and forces pedestrians toward oncoming traffic, illustrates what happens when infrastructure falls behind traffic volume.
