Burneikis Law

Lauren District's Trusted Personal Injury Attorney

Laurel District sits between two of Oakland’s most dangerous corridors. MacArthur Boulevard, the neighborhood’s main commercial spine, is on Oakland’s official High Injury Network: the city’s own designation for roads with the worst pedestrian injury records. I-580 forms the entire southern border, and its ramps at High Street and 35th Avenue are documented accident locations. Residents here cross MacArthur to reach the shops, cafes, and hardware stores along Laurel Village. They use those freeway ramps every day.

When those roads injure someone, the consequences are often severe. Burneikis Law handles personal injury cases for Laurel District residents. Our office is part of the Oakland personal injury practice serving East Oakland and surrounding neighborhoods. Call any time at (510) 328-3238 for a free case evaluation.

Why Choose Us

Why Laurel District Residents Choose Burneikis Law

MacArthur Boulevard was built as U.S. Route 50 in the 1940s: a long-distance highway designed for cross-country truck and vehicle traffic. It was never rebuilt for what it became. Today, drivers using it as an I-580 bypass bring freeway-speed traffic past Laurel ACE Hardware (operating since 1921 at 4024 MacArthur Blvd), Crumble and Whisk Patisserie, Cafe Santana, and the crosswalks that connect them all.

Oakland’s own data confirms the danger. The city’s 2024 High Injury Network update lists MacArthur Boulevard among the most dangerous corridors in Oakland. That designation matters in court: when a government body has documented a road as hazardous and failed to improve it, that history becomes relevant evidence in a pedestrian injury claim.

Monica Burneikis has recovered more than $40 million for injury victims in Oakland and across California. She has been recognized as a Top 5 personal injury attorney by Best of Oakland Magazine (2023). She is fluent in English and Spanish, and serves clients in ASL. As a solo practitioner, she does not hand files to associates or paralegals. When you call Burneikis Law, you speak to Monica. That stays true through every stage of your case.

Personal Injury Cases in Laurel District

Pedestrian Accidents on MacArthur Boulevard

The Laurel Village commercial stretch, from 35th Avenue to High Street, is a pedestrian and vehicle conflict zone. Cut-through drivers avoiding I-580 congestion share the road with foot traffic crossing to reach restaurants, transit stops, and local businesses. Crossing infrastructure is limited relative to the volume of cars using MacArthur as a freeway bypass.

When a driver strikes a pedestrian on an HIN corridor, the city’s documented history of the danger is part of the legal picture. These cases raise questions of driver negligence, government liability, and road design. The intersection of High Street and MacArthur is a major commercial crossing with multiple documented pedestrian conflicts. It deserves careful evaluation.

Car Accidents at I-580 Interchanges

The I-580 ramps at High Street and 35th Avenue are among the highest-risk points in East Oakland. A cyclist was fatally injured at the High Street and I-580 entrance in January 2023. A pedestrian died on I-580 near High Street in 2022. A separate crash near the 35th Avenue exit killed a person in the I-580 eastbound lanes. These are high-speed entry and exit points where lane merges, driver inattention, and cut-through maneuvers combine in dangerous ways.

Surface street crashes along the MacArthur commercial strip carry serious risk too. Parking is scarce in Laurel Village, and the erratic driving it produces plays out on a corridor that punishes mistakes.

Bicycle Accidents

Laurel Cyclery has anchored the MacArthur strip for years, and cyclists are a regular presence on both the boulevard and on side streets connecting Laurel to the regional trail network. The High Street and I-580 interchange is a documented fatal location for bike riders. MacArthur has limited protected cycling infrastructure, and the gap between how the road looks and how it functions is what makes it dangerous for cyclists who ride it regularly.

Students and staff commuting to Mills College at Northeastern University (5000 MacArthur Blvd) also use these corridors on foot and by bike, adding to pedestrian and cyclist exposure at the I-580 interchange.

Premises Liability and Slip and Fall

The commercial strip along MacArthur carries real sidewalk liability exposure: aging frontages, uneven surfaces, and property owners who owe a duty of care to people using their walkways. The residential stock is predominantly 1920s California bungalows and Craftsman construction. Deteriorating walkways, uneven porch steps, and deferred maintenance on aging housing are the conditions that produce premises liability claims.

Renters make up a majority of Laurel District households. That matters legally: landlord liability in tenant injury cases is a distinct body of law, and when a tenant is injured by a known hazard the landlord ignored, the case is stronger than it might appear at first.

MacArthur Boulevard is on Oakland’s High Injury Network.
That designation is not just a safety statistic. It is documented government evidence that can support a pedestrian or cyclist injury claim.

Got Questions?

Frequently Asked Questions: Laurel District Injury Cases

Does it matter that MacArthur Boulevard is on Oakland’s High Injury Network?

It can. The High Injury Network is Oakland’s official acknowledgment that MacArthur is among the city’s most dangerous corridors for pedestrians and cyclists. In a personal injury case, evidence that a government entity was aware of a road’s hazards, and failed to act, can support a claim that goes beyond driver negligence alone. The city’s own documentation becomes part of the factual record. Whether it affects your specific case depends on the facts, but it is worth discussing with an attorney.

I was hit at the High Street and I-580 ramp. Can I still recover if I was partly at fault?

California follows a pure comparative fault rule. If you share some responsibility for an accident, your recovery is reduced by your percentage of fault, but you are not automatically barred from recovering. A driver who was 80 percent at fault, for example, bears 80 percent of the damages. If you were struck at the High Street or 35th Avenue interchange and the other driver was primarily responsible, your case may have substantial value even if you were not entirely without fault.

My landlord knew about the broken walkway outside my unit and never fixed it. Do I have a case?

Possibly, yes. California landlords have a duty to maintain rental properties in a reasonably safe condition. When a landlord has notice of a dangerous condition, such as an uneven walkway, a broken step, or deteriorating porch structure, and fails to repair it, that knowledge is central to a premises liability claim. The standard is whether a reasonable landlord would have repaired it given how long the problem existed and how serious the risk was. If you were injured because of a known hazard, that matters.

How long do I have to file a personal injury claim in California after an accident in Laurel District?

In most personal injury cases, California’s statute of limitations is two years from the date of injury. For claims against a government entity, such as the City of Oakland over a dangerous road condition, the window is shorter: you must file an administrative tort claim within six months. Missing either deadline almost always bars you from recovering anything. If you were hurt recently, do not wait to get a case evaluation.

Where WE're Located

Getting to Burneikis Law from Laurel District

From Laurel Village, take MacArthur Boulevard west. At 35th Avenue, merge onto I-580 westbound. Follow I-580 west toward downtown Oakland and take the West Grand Avenue exit. Head south toward downtown, then continue to Franklin Street. Burneikis Law is at 66 Franklin Street, 3rd Floor, Oakland, CA 94607.

The drive from the Laurel Village strip runs about 10 to 12 minutes under normal conditions. I-580 peak-hour congestion can add time; if the freeway is backed up, surface streets through the Dimond District on MacArthur are a reasonable alternative.

Monica is also available by phone at (510) 328-3238 and can conduct consultations remotely if coming in is not possible.

The City of Oakland

About Laurel District

Laurel District occupies the hillside terrain above East Oakland, bounded roughly by 35th Avenue to the west, High Street to the east, and I-580 to the south. The neighborhood is also called The Laurel; the commercial zone around MacArthur is often called Laurel Village.

The housing stock is predominantly early 20th-century construction: California bungalows, Craftsman homes, and Mediterranean Revival structures built mainly in the 1920s and postwar years. Renters make up the majority of households. The annual Laurel StreetFair, organized by the Laurel District Association at 4222 MacArthur Blvd, draws thousands of visitors to the strip each year.

The neighborhood’s defining tension is its character. Laurel Village is a walkable commercial district that draws residents and visitors on foot. The roads surrounding it were not built for pedestrians. MacArthur carries freeway bypass traffic. I-580 cuts off the south side entirely. Schools, transit stops, and daily errands put Laurel residents in both corridors every day. That combination produces serious accidents.
